PEMBERIAN WASIAT WAJIBAH KEPADA KELUARGA NON-MUSLIM PERSPEKTIF IMAM SYAFI’I

Abstract

AbstractThe granting of a mandatory will to a non-Muslim family is something new in the study of inheritance law, mandatory wills are included in the ijtihadiyah issue because there has not been a Nash argument that explains this implicitly. So the argument put forward is the argument of inheritance and wills, considering that the law applies according to the place of residence and in Indonesia the majority of the population is Shafi'iyah, so this issue must be reviewed from the perspective of Imam Shafi'i. This study focuses on the granting of mandatory wills to non-Muslim families from the perspective of Imam Shafi'i.This study is classified as a type of normative research with a normative legal approach. The primary legal material in this study is the book Al-Umm volume 5 and secondary legal materials in the form of the Compilation of Islamic Law and other books and scientific papers related to wills. The legal materials collected are then analyzed so that conclusions can be drawn.The results of this study are that according to Imam Shafi'i, religious differences are an obstacle to inheritance by adhering to the hadith prohibiting mutual inheritance for those of different religions. Imam Syafi'i also believes that the meaning of the word "Infidel" is the same for everyone, whether they are idol worshipers, fire worshipers, apostates, harbi infidels or dhimmi infidels.Keywords: Imam Syyafi'i, Non-Muslim, Wasiat WajibahAbstrakPemberian wasiat wajibah terhadap keluarga non-muslim merupakan hal yang baru dalam kajian hukum waris, wasiat wajibah tergolong dalam persoalan ijtihadiyah karena belum ditemukan dalil Nash yang menjelaskan hal ini secara implisit. Sehingga dalil yang dikemukakan ialah dalil dari waris dan wasiat, mengingat bahwa hukum berlaku sesuai dengan tempat berada dan di Indonesia mayoritas penduduknya bermazhab Syafi’iyah, maka persoalan ini harus ditinjau dari perspektif Imam Syafi’i. penelitian ini berfokus tentang pemberian wasiat wajibah kepada keluarga non-muslim perspektif imam Syafi’i.Penelitian ini tergolong jenis penelitian normatif dengan pendekatan yuridis normatif. Bahan hukum primer dalam penelitian ini adalah kitab Al-Umm jilid 5 dan bahan hukum sekunder berupa Kompilasi Hukum Islam serta buku-buku dan karya tulis ilmiah lainnya yang berhubungan dengan wasiat. Bahan hukum yang terkumpul kemudian dianalisis sehingga dapat ditarik kesimpulan.Hasil dalam penelitian ini adalah bahwa menurut Imam Syafi’i perbedaan agama merupakan penghalang dalam kewarisan dengan berpegang teguh dengan hadis larangan saling mewarisi bagi yang berbeda agama. Imam Syafi’i juga berpendapat bahwa makna kata “Kafir” semua sama, baik kafir penyembah berhala, penyembah api, murtad, kafir harbi maupun kafir dzimmi.Kata Kunci: Imam Syyafi’i, Non-Muslim, Wasiat Wajibah
