JINAYAH FIQH PERSPECTIVE PROSTITUTION CASE

AbstractCommercial sex workers have become a ghost in our society, just like pornography which every time there is a government action to be dissolved, or eradicated, but will always exist and continue to exist, so what's the problem? The history of mankind is also not far from this, and it can be understood that this is caused by bad habits that are approved by most of the people, and there is no accurate action to take preventive action or even decisive action.Jurisprudence of jinayah in addressing this case, focuses on eradicating the disease of society itself, especially this adultery. To be able to fight it, it must involve 3 important elements, 1) those who have the power to enforce the law and provide strict sanctions, 2) those who actively educate through lectures, da'wah, or create good content, and 3) the basic layer of society, namely families who guide and direct their children to get to know the laws, teachings, and procedures for socializing in accordance with Islamic teachings. AbstrakPekerja seks komersil menjadi hantu di masyarakat kita, sama halnya dengan porstirusi yang setiap kali ada penanganan dari pemerintah untuk dibubarkan, atau dibasmi, akan tetapi akan selalu ada dan terus ada, lantas apa masalahnya? Sejarah umat manusia pun tidak jauh dari hal tersebut, dan dapat dipahami ini disebabkan oleh kebiasaan buruk yang diiyakan oleh sebagian besar masyakat, dan tidak ada tindakan yang akurat untuk melakukan tindakan priventif bahkan tindakan tegas.Fikih jinayah dalam menyikapi kasus ini, terfokus kepada memberantas penyakit masyarakat itu sendiri, khususnya perzinaan ini. Untuk bisa melawannya harus melibatkan 3 elemen penting, 1) mereka yang mempunyai kuasa, untuk penegakkan hukum dan memberikan sanksi yang tegas, 2) mereka yang aktif mengedukasi dengan ceramah, dakwah, atau membuat konten kebaikan, dan 3) lapis dasar masyarakat yakni keluarga yang membimbing dan mengarahkan anak-anaknya untuk mengenal hukum, ajaran, dan tata cara bergaul sesuai dengan ajaran Islam.
